Affiliate program terms

RemoteAmbition, LLC, doing business as Mercateer ("Mercateer", "we", "us", "our"), operates the Mercateer platform and this Affiliate Program (the "Program"). As a participant, you agree to abide by this Affiliate Program Agreement (the "Agreement").

Your participation is solely for legally advertising Mercateer and earning commissions on subscriptions purchased by people you refer through your personal referral link or coupon code.

By using the referral link or coupon code provided to you when you sign up for Mercateer, you accept this Agreement and its terms.

To participate, you must be at least eighteen (18) years old and have the legal authority to enter into this Agreement. Accounts registered by automated means, such as bots or scripts, are not permitted.

Each individual or business is limited to one affiliate account. Creating multiple accounts to get around any term of this Agreement will result in immediate termination.

Affiliates earn a 20% commission on referred subscription payments for the first twelve (12) months from the date the referred customer signs up. After that 12-month window, no further commissions are earned on that referral. Commission rates may differ for affiliates with special arrangements.

Commissions are paid monthly by PayPal, provided your accumulated balance is at least $100 USD. Balances below that threshold carry over to the following month. For a commission to be earned, the referred account must stay active for a minimum of seven (7) days.

Commissions are calculated on the full invoice amount, not on any discounted amount from coupon codes or promotions. You cannot refer yourself, and commissions are only earned on subscriptions purchased by new customers who have not previously held a paid Mercateer account.

Payments are issued only for transactions that complete successfully. Transactions that result in chargebacks, refunds, or payment disputes are not eligible. If a commission has already been paid on a transaction that is later refunded or charged back, that amount is deducted from future payouts.

Commission payments are processed through a third-party provider (PayPal). You are responsible for keeping your payment information accurate and for any fees the provider charges. Mercateer is not responsible for incorrect, delayed, or failed payments caused by outdated or inaccurate payment details.

Each affiliate may create one coupon code from the referral settings dashboard. The coupon gives new customers 10% off their first three months of a paid subscription. You may only promote your assigned coupon code.

You may not use misleading text on links, buttons, or images to imply that discounts or deals are available beyond the specific coupon assigned to you, and you may not bid on keywords or phrases containing "Mercateer coupon", "Mercateer discount", or similar terms that imply unauthorized deals.

You may not generate pop-ups, pop-unders, iframes, or any other visible or invisible action that sets affiliate cookies unless the user has shown clear interest by clicking a clearly marked link for the specific coupon. Users must be able to see coupon details before any affiliate cookie is set. "Click to reveal coupon" tactics that redirect or set cookies without first showing the coupon are prohibited.

The following activities are strictly prohibited and will result in immediate suspension or termination from the Program, with forfeiture of all unpaid commissions.

Spam: mass unsolicited emails, messages, newsgroup postings, or any bulk communication promoting your affiliate link or coupon code. Misleading claims: false or exaggerated statements about Mercateer’s features, pricing, or capabilities. Illegal or harmful sites: promoting Mercateer on sites that contain or promote illegal activity, hate speech, violence, explicit content, gambling, or intellectual property violations.

Failure to disclose: not disclosing the affiliate relationship in promotions that qualify as endorsements under Federal Trade Commission (FTC) guidelines or applicable law. Trademark and brand misuse: using Mercateer’s trademarks, logos, or brand assets without permission or in a way that could cause confusion, including using "Mercateer" or any misspelling or variation in domain names, social media handles, or app names.

Pay-per-click and paid advertising: bidding on or using "Mercateer", misspellings of it, or any Mercateer brand terms, product names, or variations as keywords on any paid advertising platform (including Google Ads, Bing Ads, Meta Ads, and similar) without prior written permission. Coupon and cashback sites: promoting affiliate links or coupon codes on coupon aggregator, cashback, deal, or loyalty reward sites. Dedicated affiliate sites: creating sites solely to promote Mercateer requires prior written approval.

Commission kickbacks: offering rebates, coupons, or other promised kickbacks from your commission as an incentive to use your link or code. Self-referrals: referring yourself, your own accounts, immediate family, or accounts controlled by you or your business associates. Fraudulent activity: click fraud, fake signups, bot traffic, cookie stuffing, software or browser extensions that divert or inject affiliate cookies, or any other manipulation of tracking. Account recreation: creating a new affiliate account after a previous one was terminated. Outside payments: receiving commission payments directly from Mercateer outside the Program platform.

Either party may terminate this Agreement with thirty (30) days’ written notice. Mercateer may immediately suspend or terminate any affiliate account at any time, without notice, for violations of this Agreement or for any other reason at its sole discretion.

On termination, you must immediately stop using your referral link and coupon code, and you will no longer be eligible to earn commissions. Unpaid commissions below the $100 minimum payout threshold are forfeited on termination.

Accounts with no referral activity for six (6) or more consecutive months may be terminated, and unpaid commissions below the minimum payout threshold are forfeited.

Mercateer grants you a non-exclusive, non-transferable, revocable license to use the Mercateer name and logo solely to promote the platform as part of the Program. You may not modify, adapt, or create derivative works of any Mercateer intellectual property without prior written consent.

You may create your own promotional graphics and text, provided they accurately represent Mercateer and do not violate this Agreement.

During your participation, you may have access to confidential information, including commission rates, program performance data, and internal communications. You agree to keep all such information confidential and not disclose it to any third party without prior written consent from Mercateer.

This obligation does not apply to information that is or becomes publicly available through no fault of yours, was rightfully in your possession before disclosure, is independently developed by you without reference to the confidential information, or is required to be disclosed by law.

Mercateer is not liable for indirect, incidental, or consequential damages (including loss of revenue, commissions, or data) arising from affiliate tracking failures, loss of database files, program interruptions, or any results of intentional harm to the Program or platform.

The platform and Program are provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee uninterrupted or error-free operation of the Program.

Mercateer’s total aggregate liability in connection with your participation in the Program will not exceed five hundred U.S. dollars ($500).

You agree to indemnify and hold harmless RemoteAmbition, LLC and its affiliates, subsidiaries, officers, directors, employees, agents, licensees, successors, and assigns from any and all liabilities, damages, fines, judgments, claims, costs, losses, and expenses (including reasonable attorney’s fees) arising out of or related to any claim in connection with your participation in the Program, including your negligence, misrepresentation, failure to disclose the affiliate relationship, or intentional misconduct.

Mercateer may modify the terms of this Agreement at any time, with changes effective on posting. If a modification is unacceptable to you, your only option is to stop using your referral link and coupon code and end your participation in the Program. Continued participation constitutes acceptance of any changes.

You and Mercateer are independent contractors. Nothing in this Agreement creates a partnership, joint venture, agency, franchise, or employment relationship. You have no authority to make commitments or representations on behalf of Mercateer.

This Agreement is governed by and construed in accordance with the laws of the State of Florida, United States. Any dispute arising under or related to this Agreement will be adjudicated exclusively in the state courts located in Volusia County, Florida.

You are solely responsible for all tax obligations arising from commissions earned through the Program, including federal, state, and local income taxes, self-employment taxes, and any other applicable taxes in your jurisdiction. Mercateer does not withhold taxes from commission payments.

U.S.-based affiliates who earn $600 or more in a calendar year will be issued a Form 1099-NEC and must provide a completed W-9 before the first payout is processed. Non-U.S. affiliates must provide a completed W-8BEN or W-8BEN-E to certify foreign status. Mercateer may withhold payments until the required tax documentation is received.

This Agreement is incorporated by reference into the Mercateer terms of service. By creating a Mercateer account, you acknowledge and agree to the Affiliate Program terms set out here.

Any use of a referral link, coupon code, or the referral settings dashboard constitutes your active acceptance of these terms. This electronic acceptance has the same legal force and effect as a handwritten signature.
